Employees State Insurance Act, 1948
Purpose of the Scheme
To provide certain benefits to employees in the case of sickness, maternity, and employment injury and to make provision for certain other matters in relation thereto.
Salient Features of the Scheme
- Applicable Law – Employees’ State Insurance Act, 1948
- Contributory in nature.
- Comprise of employer’s contribution and employee’s contribution at a specified rate
- Payments are made to the insured person in case of his/her sickness if certified by a duly appointed medical practitioner.
- Maternity benefits are available.
- Disablement benefits are available.
- Dependents are also benefited.
- Medical benefit
- No cash benefit payable under the Act is attachable.
- The rights to receive any payment of any benefit under the Act shall not be transferable or assignable.
- A factory once covered remains covered even if the number of employees at any later stage falls short of the stipulated number.
