Industrial Establishments (National & Festival Holidays) Act, 1963
An Act to provide for the grant of national and festival holidays, casual and sick leave to persons employed.
Important Points
- Employee means: Any person (including an apprentice) employed in any industrial establishment manual, supervisory, technical or clerical work for hire or reward whether the terms of employment be expressed or implied.
- Every Employee shall be allowed in each calendar year a holiday of one whole day on the 26th January (Republic day), 1st May (Labour Day), 15th, August, (Independence day) and 2nd, October (Gandhi Jayanthi) and Five other holidays.
- Where an employee works on any holiday allowed under section 3, he shall at his option, be entitled to twice the wages or substitute holiday with wages on one of the 3 days immediately before or after the day on which he so works.
This Act shall not apply to any employee in the post of Management or any employee where work involves travelling.
